General conditions of sale CompactPhoto Collection

Article 1 - Scope
The general conditions of sale detailed below govern the contractual relationship between the user of the site  www.compactphoto.com hereinafter called "the purchaser" and

L'Avant-Musée reserves the right to modify the conditions of sale without preavis.
Each purchase on the site www.compactphoto.com is governed by the terms of sale applicable to the date of the order.In validating your command, you accept without reserve the General Conditions after having read them. In accessing the Site, you commit yourself to respect the present conditions.
It is specified that these conditions govern the sales of CompactPhoto and Openbox frames on the site www.compactphoto.com.
These conditions are applied at the exclusion of all other conditions, including those applicable to sales in the Galerie Photo-Originale or through partner sites.

Article 2 - Essential characteristics of products and services
The products sold on the site www.compactphoto.com
- CompactPhoto Collection: art photographic prints are made on traditional silver photographic paper and laminated on a to a 2mm Dibond aluminium base.
The photographs are presented in an individual pack, accompanied by a biography of the artist.

Article 3 - Price
Prices are indicated in Euros, net, excluding the shipping fees.
Only payment in euros are accepted.
L'Avant-Musée reserves the right to modify its prices at all moments. The goods will be billed on the basis of the price list in vigor at the moment of the registration of orders, under the reserve of availability.
The good rest the property of l'Avant-Musée until the complete payment of the indicated prices. Only payment in euros are accepted.
In the case of a delivery to a country other than continental France, purcaser are the importer of the products concerned. For all the products shipped to destinations outside of the European Union and DOM-TOM, the customs duties or other local taxes of importation or taxes of the State are susceptible to be demanded.
These duties and sums do not result from the jurisdiction of l'Avant-Musée. They will be at the charge of the purchaser and result in his entire responsibility as much in terms of declarations as in the payments to the authorities and the competent organizations of your country.

Article 4 - Acceptance of the offer
Acceptance of the offer by the acquirer is achieved through validation in the context of the gallery mail, a "click validation" of all the information that must be completed by the purchaser: Name, Surname , Telephone, Shipping Address, E-mail.
The contract is concluded when the confirmation of settlement by the bank.
The site www.compactphoto.com send you a confirmation of your order by email within minutes.

Article 5 - Payment methods

Article 6 - Delivery
The CompactPhoto Collection and Openbox frames are delivered to the shipping address indicated during the ordering process.
The possible modes of delivery depend on the quantity of the article ordered and the destination country
Depending on availability, shipping or the delivery of your order will be within 2 to 10 days from the settlement date or the date of receipt of the check.
All delivery times indicated on the site are recognized as business days and do not take into account the delivery time (depending on destination).
In case of delay, a mail will be sent to the buyer.
Any delays in delivery may in no circumstances give rise to any compensation or penalties payable by l'Avant-Musée.
However not all orders shipped within a maximum period of 30 days following the date of receipt of payment may be canceled by the purchaser and will be recoverable, except in cases of force majeure (war, accidents ...)
At any time the purchaser can track his order by clicking the link on the email confirmation of order or on the website in the "Your Account"

Article 7 - Receipt of Delivery
Upon the reception of your order, it is your responsability to open the package to verify the state of the delivery.  
If you do not personally receive the package, ask the person in charge of receiving the package to make this verification.
Do not sign the delivery form if the order arrived damaged. No claim will be admissible if the delivery is signed.
In case of problems on receipt of the goods it is essential that the purchaser to establish a "list of anomalies" with the factor or the Post Office which it depends.
This form should be sent to l'Avant-Musée so that it can investigate and initiate proceedings for compensation.

Article 8 - Right of revocation
In conformity with the article L121-20 of the code of consummation, You dispose of a right of revocation for the return of a work that does not suit you. This right is not applied to gift certificates.
The purchaser has a period of 7 days from receipt of the order for the return (s) property (s) at its own expense and ask for an exchange or refund.

Article 9 - Right to return
In the case that the goods received do not conform to the order, you dispose of a right to return, any return of goods will be subject to a formal agreement between l'Avant-Musée and the purchaser. In this case, please contact l'Avant-Musée which will indicate to you the return address and the procedures of return.
L'Avant-Musée, will effect the exchange of the damaged article, within the limitation that the stock is available. In the case that an article is no longer available, l'Avant-Musée will offer you another article of an equivalent sum.
In the case of the exercise of the right to return, and only in this case, the shipping fees of the return are in charge of the purchaser and  the new shipment will be assumed by l'Avant-Musée.
Articles returned without their original packaging or incomplete, spoiled, damaged, or dirtied by the client are not reaccepted.

Article 10 - Intellectual Property
The artist, because of having taken the initiative of his creation, remains the bearer of the rights of author of his or her work, as defined by French law. The rights of representation and of reproduction of the works presented on the site www.compact-photo.com belong to their authors and to l'Avant-Musée. Their conjoint authorization is necessary for all exploitation of these rights. Your rights to the purchased work are therefore limited to a right to private use, excluding any right of representation and of reproduction.

All the elements present on the site and the site in itself are protected by the right of the author, right of trademarks, of designs, and models and/or all other intellectual property rights. By item, which we understand to be non-exhaustive: the photographs, images, designs, illustrations, texts, videos, logos, screen savers, backgrounds, trademarks, models, software programs…These articles belong to l'Avant-Musée or are utilized with the permission of their owners. Therefore, all reproduction, representation, utilization, adaptation, modification, incorporation, translation, commercialization, partial or integral by whatever procedure or on whatever medium that may be (paper, digital…) are forbidden, without the advanced written authorization of l'Avant-Musée.

Article 12 - Juridiction
The present conditions are governed by French law. In the hypothesis that litigation would be born out of the present contractual relation, the purchaser and l'Avant-Musée commit before any judiciary action to search an amiable solution. In the case of litigation, only French tribunals will be competent.

Propose to each person or entity with legal capacity or any other person duly represented by a legal representative, hereinafter referred to as "the User", a CompactPhoto printing Service online.
You represent, in your capacity for User of the site and its services, agree to these Terms of CompactPhoto printing, defined as follows:

Article 1 - Description of CompactPhoto

Article 2 - Purpose of Service
The website  www.compactphoto.com can take charge, for download on his server, digital photographs made by a User to print their CompactPhoto.
The photographs provided by the user in digital form will be stored on the server of www.compactphoto.com that for the time necessary to process transactions printing  by a professional laboratory print.
The user acknowledges having read the graphic presentation and accepts CompactPhoto completeness.

Article 3 - Photo Prints
The photos are printed on professional machines from files provided by the User. The User is responsible for the quality of files provided. The final quality prints CompactPhoto depends on the quality and definition file provided for printing.
In order to respect the work of the user, l'Avant-Musée don't made any correction for all files ordered online. The user must verify that the definition file provided respect the tecnical indication on the site. No claims will be accepted if the information in the files are not sufficient to get an acceptable print quality.

Article 4 - Obligations of l'Avant-Musée
L'Avant-Musée is committed to make every effort to ensure the integrity of the photographs and not to make anything likely to affect the work and moral rights of the User.
L'Avant-Musée shall not assign any rights in the photograph of the User to third parties.
L'Avant-Musée will not sell user information to the polling, market research and / or corporate partners in trade. The personal information collected through the site www.compactphoto.com are retained in accordance with the law "informatique et libertés' of 6 January 1978, the user has at any time a right of access, rectification and to delete personal data.

Article 5 - Obligations of the user
The user agrees to:
Respect the technical instructions, wich is indicated on the site for the upload.
Fill in the mandatory information in which it will choose the number of print, a method of delivery and the delivery address, if applicable.
Take note of the Terms of Service CompactPhoto run.
Check the displayed information including a recall of previously entered fields, the price and the conditions of service.
Provide true, accurate, current and complete information about yourself as requested in the registration form.
The User declares to be the author of the photographs uploaded.
It guarantees to l'Avant-Musée and its customers that no impediment precludes such representation and their print.
The User is liable in respect of persons photographed and documents provided.
The User is responsable for the use of  ID. In no case the responsibility of l'Avant-Musée in case of lost ID or password.

Article 6 - Code of conduct for the users
The user are responsible for all of the images thet he might transfer to us via the Site. This implies that he agrees to not transfer images or photographs that might be in violation of copyright law or any other intellectual property right law or any other applicable legislation via the site. In addition, the User may not use the Site for an illicit purpose. Therefore, he's  prohibited from uploading, distributing, ordering printed material, sending, transferrng or passing on any illicit content, in particular any image or photograph of a minor and of sexual nature. The User guarantees that the pictures transferred via the Site www.compact-photo.com are not in violation of either the right of a third party or any other legal predisposition.

The User will be held accountable for any loss or damage resulting from the violation of this clause and will compensate l'Avant-Musée in full for all the costs incurred by l'Avant-Musée (including costs for legal representation and counsel) as a result of such a violation.
L'Avant-Musée reserves the right, without notice, to take measures it will judge useful in case of violation of this cause or serious indices of such a violation, and this without giving his claims to any possible compensation. L'Avant-Musée may decide to erase any image or information stored on its servers, refuse to execute an order or put an end to all or part of the Services that are on offer to him via the Site.
Finally, l'Avant-Musée might give information about the User as well as copies of the photos or information he provided to judiciary or administrative authorities in order to meet all obligations on its part resulting from any legal predisposition.

Article 7 - Financial Conditions
The price of the CompactPhoto service printing is indicated in Euros, net, excluding shipping costs.
Only payment in euros are accepted.
The costs of delivery are also indicated in net prices.
Prices can be changed at any time by l'Avant-Musée. Modified prices are applied for all orders placed after the modification has taken place.

Article 11 - Right of revocation
The user is informed that he has no right of revocationl under the provisions of Article L.121-20-2, 1 and 3 of the Consumer Code in view of the fact that the  CompactPhoto printing service  is a custom made according to specifications made by the user.

Article 12 - Responsibility and claims
L'Avant-Musée which can not control the source of the photographs, nor their nature or their use by Users declines, therefore, any liability arising from image rights, intellectual property or other right or freedom on the basis of / for what / s a third party would be entitled to claim the User damages or sue for a crime he allegedly committed.
L'Avant-Musée assumes no liability for loss of digital files uploaded by Users, for all copies. The User must to maintain and preserve the original digital photographs that downloads on the server of the site  www.compact-photo.com.
In any event, the User guarantees to l'Avant-Musée for against all troubles, complaints or claims from any person claiming of rights as author, co-author, assignee or beneficiary of the rights of exclusive or third parties to use photographs that may affect them. User says enjoy the free use of all the photographs uploaded from the server of site www.compact-photo.com before, so that l'Avant-Musée can not be bothered by anyone, at any capacity.
The name of the photographer as well as listed securities on CompactPhoto were seized from the information supplied by the user at his order, if errors occur, shall in no case the responsibility of l'Avant-Musée can be initiated.
L'Avant-Musée in all its work to satisfy the user. However, the final rendering of aprint can not from a subjective, artistic or aesthetic, never take the character of perfection.

As such, it is the responsibility l'Avant-Musée an obligation to delivery quality prints to the user.
However, if the User claiming objective quality prints ordered, a comparison of these prints would be conducted by the l'Avant-Musée to original digital photographs provided by the User.
In case of claim, the user, can return the CompactPhoto to l'Avant-Musée, 24 rue Molière 75001 Paris.
Users will be able to request a new CompactPhoto in the smae size a refund or reissue to the same conditions, in the same format and the same files. L'Avant-Musée reimburse the User, only on proof of its cost of returning defective prints and to ensure, depending on the option chosen, the delivery of new prints or refund check.
No CompactPhoto for which reimbursement has been made will be returned to the User.
No claim will be taken into account in case of poor quality of the digital file, missing one or more of the obligations of the user, bug, virus or Trojan inserted in the appropriate photo.
